# TERMS OF SERVICE

These Terms of Service govern your use of the MarbleWave website, store, products, and related services (the "Services"). MarbleWave is operated by HongKongZhouyue Trading Limited ("MarbleWave", "we", "us", or "our") and is powered by Shopify.
By using the Services or placing an order, you agree to these Terms and our Privacy Policy: https://www.zhouyuecollection.com/policies/privacy-policy. If you do not agree, do not use the Services.
## 1. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a contract in your place of residence. You agree to provide accurate and current account, billing, payment, and shipping information. You are responsible for protecting your account credentials and for activity conducted through your account.
## 2. PRODUCTS
We try to display and describe our products accurately, but colors and appearance may vary depending on your device. Product descriptions, prices, availability, and purchase limits may change without notice. Nothing in these Terms limits rights that cannot legally be excluded.
We currently sell and ship products to customers in the United States and Hong Kong SAR. We may change the locations we serve or restrict sales where required by law or operational limitations.
## 3. ORDERS AND PAYMENT
Submitting an order is an offer to purchase. An order is accepted only when we confirm acceptance and successfully process payment. We may reject or cancel an order, including because of product availability, suspected fraud, pricing errors, or legal restrictions. If we cancel a paid order, we will refund the applicable amount.
You agree to provide accurate payment information and confirm that you are authorized to use the selected payment method. Prices exclude applicable U.S. sales taxes, shipping charges, customs duties, import taxes, and other charges unless stated otherwise. Any applicable charges will be shown at checkout where reasonably possible or may be collected separately by the relevant authority or carrier.
## 4. SHIPPING, RETURNS, AND REFUNDS
Delivery dates are estimates and may be affected by carriers, customs, and events outside our reasonable control. Risk of loss transfers as provided by applicable law.

## 5. ACCEPTABLE USE

- scrape, copy, resell, or exploit the Services without authorization; or
- use automated systems or agents in violation of our instructions, technical restrictions, or applicable law.
We may suspend or terminate access for violations of these Terms.
## 6. INTELLECTUAL PROPERTY
The Services and their content, including trademarks, text, images, graphics, audio, video, and site design, are owned by or licensed to MarbleWave and are protected by intellectual property laws. You may use them only for personal, non-commercial purposes. No other rights are granted without our written permission.
## 7. THIRD-PARTY SERVICES AND SHOPIFY
The Services may use or link to third-party tools and websites. Their use is subject to the third parties' own terms and policies, and we are not responsible for third-party content or services to the extent permitted by law.
Shopify provides the ecommerce platform but is not the seller of products purchased from MarbleWave. Purchases are made directly from MarbleWave.

If you voluntarily provide reviews, suggestions, or other feedback, you grant us a worldwide, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display it for operating and promoting the Services. You confirm that you have the right to provide it and that it does not violate any law or third-party right.
## 10. DISCLAIMERS AND LIABILITY
To the fullest extent permitted by applicable law, the Services and products are provided "as is" and "as available", without warranties other than those expressly stated by us or required by law.
To the fullest extent permitted by law, MarbleWave and its service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the Services or products. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
If you are a consumer in the United States or Hong Kong SAR, you retain all mandatory rights and remedies available under the federal, state, territorial, or Hong Kong laws applicable to you. If these Terms conflict with a mandatory consumer protection law, that law will prevail to the extent of the conflict.
## 11. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify MarbleWave against third-party claims arising from your unlawful use of the Services, violation of another person's rights, or material breach of these Terms.
## 12. TERMINATION
We may suspend or terminate access to the Services where reasonably necessary, including for violations of these Terms, fraud, security risks, or legal requirements. Provisions that by their nature should survive termination will remain effective.
## 13. GOVERNING LAW
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Subject to any mandatory consumer rights, you and MarbleWave submit to the exclusive jurisdiction of the courts of Hong Kong SAR for any dispute arising out of or relating to these Terms or the Services.
## 14. CHANGES
We may update these Terms by posting the revised version on this page. Where required by law, we will provide notice of material changes. The effective date shown above indicates when these Terms were last updated.
